My Response to The IRS

I actually kind of enjoyed writing this. It was cool to write all legalese-ish.

Dear Department of Treasury Internal Revenue Service at PO Box 1234, Someplace, USA 56789-1234,

I received notice the other day that there was an error in my 2003 Form 1040. This notice also mentions that I may owe (A LOT OF MONEY), which is broken out as (A LITTLE BIT LESS THAN A LOT OF MONEY) for a 2003 Tax Increase and (JUST ENOUGH MONEY TO MAKE IT A LOT OF MONEY) for interest on the alleged amount owed. Page 7 of this document determines the issue to be a cancellation of debt that my wife received in the amount of (A GOODLY SUM OF MONEY) from the Kentucky Higher Education Student Loan Corporation.

My following explanation should suffice as to the reasons why this debt cancellation did not show up on my 2003 Form 1040. Generally speaking, most debt cancellations result in a taxable event. Some do not. There are qualifying circumstances for tax-free treatment of a debt cancellation. I turn your attention to page 27 of Chapter 5 in the IRS's own document Publication 970 (Cat. No. 25221V) titled : "Tax Benefits for Education: For Use In Preparing 2003 Returns". I'm attaching this section to my letter.

In this section there are criteria for determining if a student loan cancellation results in a tax-free event. Note the first section: "To qualify for tax-free treatment your loan must contain a provision that all or part of the debt will be cancelled if you work:

  • For a certain period of time,
  • In certain professions, and
  • For any of a broad class of employers


The loan must have been made by a qualified lender to assist the borrower in attending an eligible educational institution. The document goes on to note that qualified lenders include:

  • The government- federal, state, or local or an instrumentality, agency, or subdivision thereof.
  • A tax exempt public corporation that takes over a hospital and whose employees are considered state employees.
  • An eligibile educational institution.


I won't go further in to reading this document. My wife works as a teacher in the (insert some godforsaken county in Kentucky) School District. Before doing so, she studied at (an expensive university). To do so, she required significant student loans. The debt cancellation that your notice references are from these student loans from the Kentucky Higher Education Student Loan Corporation.

The Kentucky Higher Education Student Loan Corporation forgives student loan interest for each year that an individual teaches at an eligible education institution in the Commonwealth of Kentucky. This would meet the first requirement of a certain period of time. It is because she is a teacher in the Commonwealth of Kentucky that she is given this forgiveness. This would certainly meet the second requirement of being in certain professions. My wife could work at any educational institution in the Commonwealth of Kentucky, so this would be a broad class of employers.

Note further that the lender in this case, the Kentucky Higher Education Student Loan Corporation is an agency of the Commonwealth of Kentucky. So it would thus be determined to be a qualified lender.

In this letter, I have demonstrated that the debt cancellation referenced in your notice should be considered a tax-free event. This being the case, you will find the previous amount of tax paid for the tax year 2003 is correct, requiring no payment to the IRS on my part.

I'll Drink To That*

We got through last night. Cooper was fussy until about midnight or so and then the Tylenol kicked in and it has been smooth sailing ever since. I had more to write earlier, but I'm not in the mood to write so much tonight. Maybe it's the beer.

Cooper prefers a bottle. And he also prefers to drink something other than the cheap beer Daddy drinks. But Daddy only drinks cheap beer to save money so he can pay for gasoline for the cars. Daddy paid $2.92 a gallon tonight at Sam's Club and he thinks he got a deal! Sucker.

Sick Boy. And Tired Parents.

Cooper did not sleep well last night. So Mommy and I didn't sleep much either. Micole took off the day to take him to the doctor and I took off the day to take care of both of them (and get a little sleep).

He has an ear infection. The doctor told Micole that it was a good thing that she brought him in or we would have had another sleepless night. The doctor prescribed amoxycillin. We know what it's like. Both Micole and I had bad ear infections as children, requiring both of us to have tubes in our ears. I even have some minor hearing loss from my ear infections.

Cooper seems to go in and out of fussiness. Sometimes he doesn't seem bothered at all and other times everything bothers him. He's even played a little in his Exersaucer this afternoon. I tried to put him down for a nap in his crib with no luck. Each time he would be crying within a couple of minutes, if not seconds.

It's such a nice day too, with Katrina dumping the Atlantic Ocean all over us. Plus there's a chemical leak outside of downtown Cincinnati that's causing lots of traffic detours.

One thing to note in Cooper's development: He is sitting up on his own, though he can't hold it for too long. He sat up in his chair to grab a shopping bag and after about 10 seconds or so he rolled right out of the chair onto the floor. He didn't like that.

He really wants that bag.

Poor Boy

I didn't get many pictures tonight. It's the least number of photos I've taken of Cooper, excluding the one day where I didn't get to take any.

Poor Cooper isn't feeling well tonight. He was fussy last night which was a nice little in the bed, get out of the bed night for Mommy and Daddy. We kind of split duty. I was up for a little while. She was up for a little while. Cooper appears to have some kind of a cold. Sometimes he's hot. Sometime's he's not. He had a little puking incident this evening. The bananas did not go down. So now it's just after 8 and he's already in his crib.

Are You Ready for Some Football?

Cooper occasionally watches television, but most of the time he doesn't care. He really liked watching the Bengals play in their preseason game on Friday night. He stared intently at the screen. I don't know why he was so interested. I watched it and wish I hadn't. They were losing 27-3 at halftime.

For all of those interested, make note that it is only 83 days until Ohio State beats Michigan. I live kind of a weird situation. I'm a diehard Buckeye fan, but I married a Michigan girl. So most of my in-laws are Michigan fans. They ride me all the time about it, but just remember Ohio State has won 3 of the last 4.

Today we drove with my dad and grandmother, to see my grandfathter and my sister. Here you can see Pappy with Cooper. We were definitely out in the country. Plenty of corn in the background. Cooper just seems so big to me now. He's at least doubled in weight in just 5 months. Soon we won't be able to use his current car seat.

Everybody's Working For The Weekend

It was actually a pretty good night with the photo taking. There were a lot of pretty nice photos that won't be shown here. This one really stands out because I caught him looking at the camera and smiling. That's an amazing feat in itself.

Pappy came over this evening to visit us. He's fussy here, but he was actually pretty calm with Pappy; which means he didn't cry right away. It was kind of nice. I was starting to think Cooper might give Pappy some kind of complex.

It was hard to find any pictures that I took tonight, where Cooper hadn't gotten some kind of liquid substance on himself, whether it was from his own making or not. He's slobbering or he's crying or he's spitting up or he's just spreading cereal all over himself with his hands. That was pretty much the way our evening went.

There's a basic law of gravity that we all know: Whatever goes up must come down.

And there's the corrollary I've discovered with babies: Whatever goes in must come out.

The Worst Kind

There's a line in the John Prine song "Jesus: The Missing Years" that goes "All the world smelled like poop. Baby poop that is ..the worst kind". Everytime I changed Cooper's diaper I thought of that line and I had to disagree with John. That was when Cooper was still breastfeeding. Since he's become a formula only baby, I have to say that John Prine is a songwriting genius. I would've said that anyways, but tonight, Mommy left for Target (pronounced Tar-Jhay). Cooper decided to leave me a surprise. Oh, God. It was horrible. Just horrible. Definitely the worst kind.

And In This Corner...

I don't know what to say about today, so I'll just ramble.

We bought Aunt Kelly an (deleted) for her birthday. I think she'll really like her (deleted). Some people just rave about those (deleted). Someday maybe I'll get an (deleted) for myself.

Micole goes back to work tomorrow for the first time since mid-March. Which means I have to start getting up at night when Cooper gets fussy. Great. I'm not ready. At all. Me likey the sleepy time.

It's going to be very hard on Micole. She's been right by Cooper's side for about 90% of his life and suddenly she's going to be without him for 8 hours a day. It will be a struggle. It's hard enough for me. Quite often I find myself staring at his pictures at work and thinking about how much I miss the little guy. The boy's gonna get me fired. Probably not, though. My boss drew a mustache and devil's horns on one of Cooper's pictures, so I think I have a pretty good lawsuit if it came to that.

For any Big Brother fans out there (Micole watches every reality show known to man; I get dragged in): Kasar we already miss you. (Playing with my voodoo doll) Die, Jennifer, die!

I received some really good free entertainment at work today. My office is on the 11th floor. Every now and then you'll hear a protest march or the police recruits chanting as they march by, but usually it's pretty quiet. This morning, I heard some people arguing. I looked out the window. Two girls were fighting in the middle of the street. Blocking traffic. Lightning jabs. Hair pulling. Clothes grabbing. Smack talking. Wrestling and throwing each other up against parked cars. Knocking over tables outside of the smoothie place across the street. Their friends trying to separate them. I wondered aloud why no one had called the police, but then of course, I wasn't dialing either. It was definitely better than Tyson vs Spinks. And it only took the cops 20 minutes to get there, but by then the fight had dispersed.
